Independent expertise, from the first hour of an incident to the witness box

Digital forensics and incident response since 2003, from law enforcement support and the courtroom to leading national response teams and security functions. Now available directly through Cognisn.

Expert witness and expert reports

Independent expert opinion on digital evidence, prepared for the court rather than for a side. Matthew Westwood-Hill has prepared expert reports and given evidence for more than ten years, across hundreds of matters.

Instructed byBoth sides: prosecution and defence, applicants and respondents
Concurrent evidenceExperience giving evidence concurrently with an opposing expert

Reports are prepared in accordance with the Federal Court's Expert Evidence Practice Note (GPN-EXPT), the Harmonised Expert Witness Code of Conduct and the equivalent state codes. The expert's paramount duty is to assist the court impartially, not to advocate for the party that retains them.

Typical matters include:

  • Departing employees taking data, client information or intellectual property
  • Authenticity, alteration or backdating of emails and documents
  • Reconstructing a timeline of user and device activity
  • Examination of mobile phones and messaging data
  • Data breaches: what was accessed, when, and by whom
  • Independent review of an opposing expert's methodology and conclusions

Forensic examination

Forensically sound acquisition and examination of computers, mobile devices, email and cloud accounts, with documented methodology and chain of custody, so that findings can be reproduced by another examiner and relied on by the court.

  • Acquisition of devices, cloud tenancies and mailboxes, on site or remotely
  • Analysis of user activity, file access, deletion, external storage and transfers
  • Findings reported in plain language, with the technical detail available for scrutiny

This work began in 2003, combining computer forensics with training in questioned document examination, a grounding that still informs matters about the authenticity of documents and signatures. Credentials include the GIAC Certified Forensic Analyst (GCFA) and AccessData Certified Examiner (ACE).

eDiscovery

Defensible handling of electronically stored information across the whole process: collection, processing, review and production, on platforms including Nuix and Relativity. Experience spans independent practice, a national law firm's litigation support group and large-scale matters for multinational clients, so the work is shaped around how legal teams actually run a matter.

  • Scoping and proportionality advice before collection begins
  • Collection from Microsoft 365, email systems, file shares, devices and cloud sources
  • Processing, de-duplication, filtering and preparation for review
  • Production in the formats and load files the other side or the court requires

Training

An experienced trainer in forensic analysis and eDiscovery, available to train legal, investigation and security teams in sound evidence handling, analysis techniques and the platforms they use.

Organisations under attack

Incident response leadership

When an incident is under way, decisions in the first hours shape everything that follows: the evidence that survives, what must be notified and to whom, and what it costs. If your incident is active now, choose "Active incident, needs help now" on the enquiry form and it will be prioritised.

  1. CommandEstablish leadership and a decision log
  2. ContainStop the spread without destroying evidence
  3. PreserveCapture what investigators and lawyers will need
  4. CoordinateLawyers, insurer, executives and vendors
  5. Decide and notifyNegotiation, regulators, customers
  6. RecoverRestore safely and uplift
How the first hours of a response are structured. Several stages run in parallel.

Incident command and coordination

Leadership of the response from the first hours, engaged directly by organisations, by their law firms or by their insurers, and coordinating across all of those parties. Experience includes leading large-scale responses for multinational organisations in the telecommunications, energy, industrial and government sectors, covering ransomware, cloud compromise and targeted intrusion.

  • Incident command, coordination and executive briefing
  • Containment and investigation, preserving evidence for later use
  • Coordination between the organisation, its lawyers, its insurer and response vendors
  • Regulator and insurer notification management, including the Notifiable Data Breaches scheme
  • Recovery, lessons learned and uplift after the incident

Threat actor negotiation and ransom decision support

Experience across more than a dozen negotiations with threat actors, covering negotiation strategy, preparation of responses, and conducting the negotiations themselves.

  • Negotiation strategy, aligned with legal advice and the insurer
  • Preparing and conducting communications with the threat actor
  • Decision support on whether to pay, including sanctions screening
  • Meeting the mandatory ransomware payment reporting obligation under the Cyber Security Act 2024, which requires businesses with annual turnover of $3 million or more to report a payment to the Australian Signals Directorate within 72 hours
Advisory and development

Security leadership and engineering

Senior security leadership without a full-time hire, and engineering where off-the-shelf tools fall short.

Virtual CISO and board advisory

Drawing on experience as a Global CISO and as the leader of a national broadcaster's security function, ongoing or fixed-term security leadership for organisations that need it at board and executive level. That includes having led security engineering, operations, incident response and architecture teams, and briefing boards, executives and government agencies including ASD and the ACSC.

  • Security strategy, risk management and board reporting
  • Certification and compliance programmes: ISO 27001, SOC 2, the Essential Eight and NIST CSF
  • Privacy obligations across several countries
  • Red team exercises, internal audit and third-party security assessments
  • Post-incident uplift and assurance for customers, insurers and regulators

Development

Software engineering for security and evidence work, from the same practice that publishes open source tools used on engagements. Background includes leading commercial software teams building enterprise forensic and data discovery products, and originating a deep and dark web monitoring platform recognised in EY's global innovation programme.

  • Custom forensic and data processing tools built for a specific matter
  • AI and MCP integrations that connect models safely to an organisation's systems
  • Secure code and architecture review
  • Automation for security operations
How engagements work

From enquiry to engagement

  1. EnquiryA short outline, with no confidential or privileged material yet
  2. Conflict checkCompleted before any detail is discussed
  3. Scope and termsAgreed in writing. For litigation, engaging through your solicitors helps maintain privilege
  4. Secure exchangeA secure channel for material and evidence
